Terms of Use

These terms apply to your use of the Graftly website and platform (the "Service"), operated by Graftly, a UK-based company providing compliance and site documentation tools for trades and service businesses. By accessing or using the Service, you agree to these terms.

1. The Service

Graftly provides a mobile-first platform that helps users create site documentation including RAMS, risk assessments, method statements, COSHH assessments, toolbox talks and related safety documents. The Service is currently offered in an early access (beta) phase and features may change as the product develops.

2. Accounts

You are responsible for keeping your account credentials secure and for any activity that happens under your account. Notify us promptly at info@graftly.co.uk if you believe your account has been compromised.

3. Acceptable use

  • Use the Service lawfully and in line with these terms.
  • Don't attempt to break, reverse engineer or misuse the Service.
  • Don't upload content that is unlawful, harmful, or infringes anyone else's rights.

4. Your documents and data

You retain ownership of the content you create within Graftly. You grant us a limited licence to host, process and display that content solely so we can provide the Service to you. We do not sell your documents or data.

5. Compliance disclaimer

Graftly is built to help you produce site documentation aligned with UK Health and Safety Executive (HSE) best practice. However, Graftly is a tool — you remain responsible for ensuring your documentation is accurate and appropriate for the specific work being carried out, and that you meet your own legal duties.

6. Payments

During the beta, the Service may be free or offered at founding user pricing. If and when paid plans are introduced, any payment processing will be handled by a trusted third-party provider (currently expected to be Stripe). We'll be clear about pricing before charging you.

7. Availability

We aim to keep the Service available and reliable, but we don't guarantee it will always be uninterrupted or error-free. We may carry out maintenance or update features from time to time.

8. Termination

You can stop using the Service at any time. We may suspend or terminate your access if you breach these terms or use the Service in a way that puts other users, third parties or the Service itself at risk.

9. Liability

To the extent permitted by law, Graftly is provided "as is" without warranties of any kind. Our liability to you for any loss arising out of your use of the Service is limited to the fees you've paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under UK law.

10. Hosting and providers

The Graftly website and platform are hosted using cloud infrastructure suitable for delivering a modern web application. Where we use third-party providers (for example payment processors), we choose providers with appropriate security and data protection standards.

11. Governing law

These terms are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll let you know via the Service or by email where appropriate.
